1. Acceptance of terms

By accessing or using the Torneyo platform ("Service"), you agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service.

2. Definitions

• Platform: the website, application, and services offered by Torneyo.
• User: any individual or legal entity using the platform.
• Organizer: a user who creates and manages championships on the platform.
• Athlete: a user who participates in championships as a player.
• Content: data, text, images, and information inserted into the platform.

3. Service description

Torneyo is a SaaS platform that enables the creation, management, and promotion of sports championships. The Service includes tools for: team and athlete registration, automatic bracket generation, digital scoresheets, real-time standings, financial management, participant communication, and public widgets for promotion.

4. Account creation

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your access credentials and for all activities conducted under your account. You must immediately notify us of any unauthorized use of your account.

5. User obligations

By using Torneyo, you agree to:

• Provide truthful, accurate, and up-to-date information.
• Not use the platform for illegal or unauthorized purposes.
• Not violate third-party intellectual property rights.
• Not interfere with the operation or security of the platform.
• Not attempt to access other users' data without authorization.
• Not use bots, crawlers, or automated scripts without prior authorization.
• Respect the rules of the championships in which you participate.
• Not post offensive, discriminatory, or illegal content on the platform.

6. Plans and payments

Torneyo offers free and paid plans (Starter, Pro, Enterprise). Details of each plan are available on the pricing page. Subscriptions automatically renew until canceled. Cancellation can be made at any time, and access to the paid plan remains until the end of the billed period.

All payments are processed by Stripe. We do not store credit card information. Charges are made in BRL (Brazilian Real) for Brazilian customers and USD (US Dollar) for international customers, and may be subject to applicable taxes in accordance with local law.

7. Intellectual property

Torneyo owns all intellectual property rights related to the platform, including code, design, logos, trademarks, and functionality. Content inserted by users (championship data, teams, athletes) belongs to the respective users, who grant Torneyo a license to store, process, and display such content as necessary for the provision of the Service.

8. Public data

By using Torneyo, you acknowledge that championships marked as public will have their information (standings, matches, statistics) available for viewing by anyone, including in widgets embedded on third-party sites. Organizers may choose to make their championships private.

9. Limitation of liability

Torneyo provides the Service "as is" and "as available," without warranties that the Service will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, Torneyo shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the Service, including data loss, lost profits, or business interruption.

Torneyo's total liability for any claim arising from these terms or the use of the Service is limited to the total amount paid by you in the 12 months preceding the event giving rise to the claim.

10. Termination and suspension

Torneyo may suspend or terminate your access to the Service at any time, with or without cause, upon prior notice when reasonably possible. In the event of a material breach of these terms, termination may be immediate. Upon termination, your data will be retained for 90 days to allow for export, after which it will be deleted or anonymized.

Organizers may delete their championship at any time. Deletion is irreversible and results in the removal of all associated data (teams, athletes, matches, and statistics).

11. Privacy

The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms of Service.

12. Changes to terms

We reserve the right to modify these Terms of Service at any time. Significant changes will be communicated to users by email or through a notice on the platform at least 30 days in advance. Continued use of the Service after the changes take effect constitutes acceptance of the new terms.

13. Governing law and jurisdiction

These Terms are governed by Brazilian law. For users in the European Union, additional rights under the EU Consumer Dispute Resolution Regulation may apply. The courts of São Paulo - SP, Brazil shall have jurisdiction to resolve any disputes arising from these Terms, without prejudice to consumer protection rights provided by applicable law.
